Restructering and Insolvency

Udink & de Jong operates on a national and international level in the field of Reorganisations and Insolvency. The team is made up of 10 individuals who all have many years of experience in this practice. The majority of our team are members of the professional association INSOLAD (www.insolad.nl) and Marc Udink is Secretary General (CEO) of INSOL Europe (www.insol-europe.org). INSOL Europe is the European organisation for professionals who specialise in reorganisations and receivership.
Udink & de Jong is engaged by banks and other financial institutions in order to provide clarification in relations with their clients and to provide management services where required. This part of the practice is closely linked to the Banking law practice under the Corporate Law section.
Over the years, Udink & de Jong has been appointed administrator or bankruptcy trustee within the context of many major and socially relevant moratorium and bankruptcy proceedings. Udink & De Jong has also been asked to provide management services in a number of cases involving the "undisclosed administration" of (semi-) governmental institutions. This was made possible by the large and extensive network that the firm has established and that also operates within the interface between the public and the private domain.
In this context, a great deal of expertise has also been built up in the field of combating fraud. Here the firm collaborates in bankruptcy proceedings with the Public Prosecution Service and the special investigation services. Udink & de Jong also issues recommendations to the Ministries and the standing parliamentary committees of the Lower House. Over the years, a considerable number of our recommendations have been adopted and incorporated into the text of laws.
Furthermore, our policy recommendations have been adopted by the implementing bodies for, for example, the social security system. The firm recently issued a recommendation with regard to the so-called "directorship ban", which aims to make it impossible for persistent fraudsters to register with the Chamber of Commerce. The Minister of Justice recently adopted this position and the Cabinet has ordered that the recommendation be implemented in the form of legislation.
These activities also indirectly contribute towards our clients' business operations. After all, if the fraudulent activity that takes place is reduced, less economic damage will be incurred and the better the investment climate, the stronger the financial position of law-abiding entrepreneurs.
